Position Description
This role works cross-functionally with the Infosys Client Account Manager, the Infosys Financial Manager, the Infosys Delivery Manager and the Client equivalents to assure that the contract or contracts are being monitored and executed in accordance with the Parties obligations, in particular also detecting any major deviations from the scope of services requested by the Client.
The Contract Manager has primary responsibility for monitoring the execution of the contract, ensure that scope deviations are identified and tracked, and if the Infosys Account Manager finds it appropriate, to prepare and negotiate change requests as to ensure that agreed contract changes are adequately turned into amendments to the Contract. The Contract Manager is also the focal point for any requests for interpretation of contract terms. In cases where contract terms are in dispute between Infosys and the Client, this role is the subject matter expert advocate for Infosys. The Contract Manager is the receiver of any contract change initiated by the Client.
In many situations, the Contract Manager role is performed by the Delivery organization in a company, and less frequently, by the Legal department. Mature service providers have institutionalized contract management and integrated this function in the overall process framework. This can be successful if these service providers recognize the complex nature of a services agreement, and the requirement to respond very quickly to requests for support, changes, interpretations, and other needs. The Contract Manager must in any case have a deep grasp of the contract structure and terms, the scope of services and the relationship of the services to the business operations they support. This calls for a closer working relationship between these departments and the business operations team than is typical in the Infosys organization.
Primary Reponsibilities:
The Contract Manager needs to have a finger on the pulse of the contract and performance to be most effective.
Know and understand the contract in detail
Develop tools to support the Service Delivery and Governance teams, specifically the Deliverables & Obligations trackers, and refresh these as the contract evolves over time
Support the Governance and Service Delivery team’s monitoring of the Infosys compliance with contract terms and conditions, routine communications and reports and critical deliverables, as well as tracks the performance by the Client of any
Monitor and maintain Client’s compliance with contract terms and conditions, Infosys obligations, client obligations, prerequisites and dependencies and notifications
Ensure auditability of the contract as required in the various sections (billing, standards compliance, service delivery, and so forth). Respond to Client request and manage audits with appropriate delivery team members and the Clients audit organization in accordance with the process established in the Client’s Policy & Procedures Manual
Act as the lead negotiator for all amendments, contract interpretations, new services and any other issues requiring contractual resolution
Facilitate timely problem resolution of contractual issues to minimize impact of service disruptions on Client
Ensure that the contract is modified as necessary to meet Client’s evolving business needs, in accordance with the process established in the Client Policy & Procedures Manual
Respond to requests of the Client and manage benchmarking activities in accordance with the respective
Ensure that all terms and conditions of agreement are satisfied; educate the delivery and service management team periodically to ensure that the entire team understands the contract terms, obligations, service performance parameter, pricing terms and deliverables
Negotiate any required third-party contract assignments and ensure compliance with terms and conditions of consents and manage any relationship where Client has requested Infosys to coordinate with other service providers
Evaluate Performance Credits, Deliverable Credits or KPIs and approve any action plans resulting from critical service performance failures
Evaluate and approve any commitments for delivering Innovation,
Approve, authorize, and oversee all contract-related Infosys policies and procedures, and ensure compliance with Client’s policies and procedures.
Manage a Contract Administrator(s) if applicable
