This position is based in Munich or Vienna.
MISSION STATEMENT
To provide high quality, timely legal support for operational and commercial activities for Moët Hennessy’s Austria, Germany & Switzerland (“AGS”) distribution businesses. In addition, some time may be spent supporting Moët Hennessy’s wider European business. Reporting to Legal Director of EMEA region.
MAIN RESPONSIBILITIES
To deliver best in class legal services in the following areas:
1. Commercial Legal Matters:
- Be the first point of contact for all legal matters within the AGS markets;
- Proactively deliver business-focused solutions for operational and commercial legal issues occurring in the AGS markets;
- Lead the negotiation and/or drafting of a wide range of commercial and other legal agreements for the AGS markets including T&Cs of sale and supply, sponsorship, influencer, services and agency agreements;
- Support AGS’s sales and marketing activities, including:
o Negotiating competition T&Cs, supplier agreements, sponsorship agreements, website terms of use, influencer agreements, etc.;
o Reviewing promotional material, product packaging, point of sale materials, etc., from both AGS and the Maisons for compliance with applicable advertising and promotion rules;
o Deliver marketing legal training to the AGS marketing team;
o Liaise with the relevant regulatory authorities and organisations (Deutscher Werberat, BSI, Österreichischer Werberat,BAZG, etc) where necessary;
- Work with the relevant stakeholders to create, strengthen and enforce policies and processes in AGS relating to legal topics;
- Take the lead in creating and maintaining an AGS legal template database;
- Work with the MH EMEA and MH central legal teams on branding matters and the Maison legal teams to provide AGS legal advice where needed;
- Instruct and manage external counsel where required and in accordance with MH EMEA legal department budgets.
2. Compliance Matters:
- Work with the Legal Director EMEA to drive engagement with, and adherence to, corporate compliance programmes;
- Guide and advise the AGS Ethics & Compliance Correspondents in conjunction with the MH central compliance team;
- Assist in the maintenance of a robust competition law programme including by organising mock dawn raids and audits;
- Provide support and assistance to AGS in conjunction with the MH central DPO and, where relevant, the MH Deutschland external DPO to ensure continued compliance with applicable data protection legislation.
3. Corporate Legal Matters:
- Support AGS in implementing any changes required to market legal entity governance structures;
- Ensure that the MH central corporate database is updated as required;
- Facilitate the creation and submission of relevant corporate filings in the AGS markets.
4. Corporate Legal Matters:
- Support the Legal Director EMEA on projects and activities outside AGS when required.
Education & Qualifications
- Excellent academic results;
- Law Degree or equivalent;
- Legally-qualified to practice in at least one of the AGS (Germany, Switzerland, Austria) markets;
- Current certificate to practice in at least one of the AGS (Germany, Switzerland, Austria) markets.
Languages
- Fluency in German and English are essential;
- Fluency in one or more relevant European languages would be an advantage.
Professional experience & know how
- At least 5+ years’ relevant experience practising law;
- Significant in-house experience in a multi-national corporation;
- Experience leading on a variety of commercial legal matters, ideally with experience of handling marketing and advertising compliance reviews;
- Prior FMCG/Retail/Luxury experience would be an advantage.
